Welcome to Diversity Assam ("Diversity Assam," "we," "our," "us"). These Terms and Conditions ("Terms") govern your access to and use of our website, platform, products, content, and services available at https://www.diversityassam.com/ (the "Platform").

By accessing, browsing, or using the Platform, you agree to be legally bound by these Terms.

1. Definitions

For clarity in these terms:

User/You: Any visitor, registered user, or customer on the Platform.
Services: All services offered through the Platform, including travel content, trip planning, bookings, events, itinerary tools, and related offerings.
Trip/Booking: Any purchase, reservation, or request for travel services, including trips, activities, events, and/or hotel bookings.
Partners/Service Providers: Travel agents, tour operators, hotels, event organizers, and other third-party entities whose services may be listed on the Platform.
Content: Text, images, video, graphics, guides, listings, and all information displayed on the Platform.

2. Eligibility

You must be at least 18 years old (or the legal age in your jurisdiction) to use the booking features of this platform. If you are under 18, you may browse content, but you must not submit bookings without a parent/guardian.

3. Scope of Platform Services

'Diversity Assam' may provide:

•travel destination guides, blogs, photos, and cultural content
•itinerary tools and trip planning
•listings for trips, events, accommodations, attractions, and experiences
•partner connections and inquiry forwarding

Important: Diversity Assam may act as a facilitator between users and partners. The actual service delivery (trip/event/stay) is performed by the partner unless explicitly stated otherwise.

4. User Accounts

To access certain services, you may need to register an account.

You agree to:

•provide accurate, complete information
•Keep your login credentials confidential.
•Be responsible for all activities under your account.

We may suspend or terminate your account if:

•you violate these terms.
•You engage in suspicious, abusive, fraudulent, or illegal activity.
•you provide false information

5. Bookings, Pricing & Payments

5.1 Services that Require Transactions

•As of January 18, 2026, services that require transactions are limited to booking hotels & stays, tour packages, and cab bookings done directly or through partner travel agencies.
•Prices displayed may include or exclude taxes and other charges depending on the listing. Any inclusions/exclusions will be displayed in the booking details.
•Prices may change at any time, but changes will not affect confirmed bookings.

5.2 Payments

•Payments may be processed via third-party payment gateways. By making a payment, you agree to the payment provider's terms as well.
•We are not responsible for payment gateway downtime, failures, or transaction delays.

5.3 Booking Confirmation

•All bookings are confirmed only after receipt of the required advance payment, as specified at the time of quotation or confirmation. +
•Advance amounts may vary based on hotel policies, seasonality, and vendor terms

5.4. Balance Payment

•The full balance payment must be received before the commencement of travel or as per the agreed payment schedule.
•Failure to clear the balance on time may result in cancellation of services, and applicable cancellation charges will apply.

5.5 Price Validity & Revisions

•All prices are subject to availability at the time of booking.
•Any increase in hotel tariffs, cab charges, fuel costs, tolls, parking fees, local taxes, or government levies shall be borne by the client.

5.6 Delayed or Non-Payment

•The company reserves the right to revise pricing or cancel bookings without prior notice in case of delayed or non-payment.

6. Cancellations & Refund Policy

6.1 Cancellation Procedure

•All cancellation requests must be made in writing (email or WhatsApp)
•The date on which the written request is received will be treated as the effective cancellation date.

6.2. Indicative Cancellation Charges (Subject to hotel/vendor policies)

•More than 21 days prior to check-in/travel date: Minimal or vendor cancellation charges
•14–21 days prior: 25% of total booking amount
•7–14 days prior: 50% of total booking amount
•Less than 7 days / No-show: 100% cancellation (no refund)

6.3 Hotels & Stays

•Cancellations, amendments, early check-outs, and no-shows are governed strictly by the respective hotel's cancellation policy.
•No refunds will be provided for unused nights or services.

6.4 Tour Packages

•Cancellation charges will be calculated based on the cancellation policies of hotels, transport providers, and other included services.
•Once the tour has commenced, no refund will be applicable for any unused or missed services.

6.5 Cab Bookings

•Cab cancellations made within 24 hours of scheduled pickup may attract 100% cancellation charges.
•No refunds will be issued for delays or non-utilization caused by client-side delays, itinerary changes, or late reporting.

6.6 Refund Processing

•Approved refunds, if any, will be processed within 7–14 working days after receipt of refunds from the concerned vendors.
•The company shall not be responsible for delays caused by hotels, cab operators, or banking channels.

6.7. Force Majeure

•In case of natural calamities, weather conditions, landslides, strikes, road blockages, or government restrictions, refunds (if any) will be governed strictly by vendor policies.
•No guaranteed refunds in such force majeure circumstances.

7. Partner Services & Third-Party Responsibility

Many services shown on Diversity Assam are offered by third-party partners.

You understand and agree:

•Partners are responsible for actual service delivery.
•Diversity Assam is not liable for partner conduct, service quality, delays, cancellations, safety issues, or failures.
•Disputes related to service delivery may need to be resolved with the partner directly.

However, we may assist in communication and escalation where possible.

8. Travel Risks & User Responsibility

Travel may involve risks, including weather, road conditions, wildlife, political disruptions, health issues, and unexpected events.

You agree:

•to evaluate your fitness for travel
•to follow local laws and safety instructions
•to carry valid identity documents
•to comply with all trip requirements, including permits and guidelines (e.g., protected areas)

Diversity Assam is not responsible for personal injury, loss, delays, or disruptions arising from factors beyond our control.

9. Platform Content Disclaimer

While we aim to keep information accurate and updated:

•Travel facts, timings, prices, routes, availability, and conditions may change.
•Guides and articles are informational and not guaranteed.

Diversity Assam does not warrant that content is always complete, correct, or up-to-date.

10. Intellectual Property

All platform content—including text, images, videos, layout, branding, and design—is owned by Diversity Assam or our partners.

•Use our logo, brand name, or content without written permission

You may share links to our pages with proper attribution.

11. Prohibited Use

You must not:

•attempt to hack, scrape, overload, or disrupt the Platform
•Use bots or automated tools without written permission
•post spam or misleading promotions
•Impersonate others or misrepresent identity
•violate laws, privacy, or intellectual property

Violation may lead to immediate account termination and legal action.

12. Privacy & Data Protection

13. Promotions & Marketing

We may provide offers, coupon codes, or promotional campaigns. These:

•cannot be redeemed for cash unless stated otherwise

14. Force Majeure

We are not liable for delays or failure to perform caused by events beyond reasonable control, including:

•natural disasters, floods, storms, earthquakes
•strikes or lockdowns
•internet or telecom failure
•government restrictions
•war, unrest, or public emergencies

15. Limitation of Liability

To the maximum extent permitted by law:

•Diversity Assam's total liability for any claim shall not exceed the amount paid by you for the specific booking/service giving rise to the claim.
•We are not liable for indirect, incidental, punitive, or consequential damages, including loss of profit, loss of data, or business interruption.

16. Indemnity

You agree to indemnify and hold harmless Diversity Assam, its directors, employees, and affiliates from any claims, losses, or damages arising from:

•your misuse of the Platform
•your violation of these Terms
•your violation of any third-party rights
•disputes caused by your conduct during a trip/event/stay

17. Termination

We may suspend or terminate your access to the Platform:

•without notice if required for security or legal reasons
•if you breach these terms

You may stop using the platform at any time.

19. Changes to Terms

We may update these terms from time to time. Updates will be posted on this page with the revised "Last updated" date.

Continued use of the Platform after changes means you accept the updated Terms.

20. Governing Law & Jurisdiction

These Terms are governed by the laws of India.

Courts located in Assam, India, shall have exclusive jurisdiction over disputes arising under these Terms, unless otherwise mandated by applicable law.
